Rahul Gandhi Re-elect As MP After SC Stays Conviction In Defamation Case

On August 5, 2023, the Supreme Court put a hold on Rahul Gandhi's conviction and sentence that was given by Chief Judicial Magistrate HH Verma in Surat on March 23, 2023.

Two days after the Supreme Court put a hold on Rahul Gandhi's conviction in a criminal defamation case, the Lok Sabha Secretariat on Monday allowed him to return to Parliament.

His status as the Member of Parliament (MP) for Wayanad was formally restored.

Here are some of the things that will change for Rahul Gandhi:

He will be able to attend Parliament sessions and participate in debates and discussions.

He will be able to vote.

He will be able to ask questions in Parliament on behalf of his constituents.

When Parliament is in session, he is entitled to an additional ₹2,000 per day. MPs are also entitled to a travel allowance, which includes free train travel. They also receive medical facilities for themselves and their family members, housing, telephone, water, and electricity.

Rahul Gandhi will receive a monthly salary of ₹1 lakh as an MP. He will also receive an additional ₹2,000 per day when Parliament is in session. He will also be entitled to a travel allowance, medical facilities, housing, telephone, water, and electricity.

According to the Housing and Telephone Facilities (Members of Parliament) Rules, 1956, each MP is entitled to housing accommodation in the form of a flat without paying a licence fee. Rahul Gandhi will be entitled to free housing in the form of a flat as an MP.

Rahul Gandhi filed a petition in the Sessions Court asking them to stop his conviction from being carried out. Section 389 of the CrPC allows a Supreme Court to do this for people who have been sentenced to less than three years in prison. However, the Sessions Court rejected his plea, so he moved to the High Court, which also rejected the plea.
